Welcome to Control-It (the “App”). These Terms of Use and End User License Agreement (collectively, the “Terms”) govern your use of the App, the control-it.app
website, and any related services we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
This AUP applies to any connection to the Control-It CloudKit container or any future hosted API.

The Services and all related intellectual property are owned by Micah Crandell or its licensors. You receive no rights except those expressly granted in these Terms.
If you submit or upload content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to operate and improve the Services. You represent that you have the necessary rights to grant this license.
If you purchase Control It Pro, the following terms apply:
Prices may change. If they do, Apple will generally notify you and you can cancel before the new price takes effect.
Refunds for purchases made through the App Store are handled by Apple under its policies. We do not issue direct refunds for App Store purchases.

The Services may rely on third-party services (e.g., Apple, CloudKit, network APIs). Your use of those services may be subject to their own terms. Where you obtained the App from Apple, you acknowledge Apple is not responsible for providing maintenance or support for the App.
We may suspend or terminate your access at any time if (a) you breach these Terms, (b) we discontinue the Services, or (c) required by law. Sections that by nature should survive (e.g., IP, disclaimers, limitation of liability, indemnity, governing law) survive termination.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Services is limited to the greater of (a) the amount you paid to us for the Services in the 12 months preceding the claim, or (b) US $50. We are not liable for any indirect, consequential, incidental, special, punitive, or exemplary damages.
You agree to indemnify and hold harmless Micah Crandell, affiliates, officers, employees, and agents from any claim, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or breach of these Terms.
You may not use, export, or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. You represent you are not located in a country or on a list subject to U.S. embargoes or sanctions.
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws principles.
We may update these Terms from time to time. For material changes, we will provide notice in-app or on our website at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
